Sub: Tamizhaga Murpokku Makkal Katchi- Opinion- Draft Scheme- the Award of the Cauvery Water Disputes Tribunal dated 5-2-2017-Reg.
Tamizhaga Murpokku Makkal Katchi submits the following points in respect of the Draft Scheme submitted by the Central Government ibn the Supreme Court of India for implementing the Award of the Cauvery Water Disputes Tribunal. The draft Scheme filed by the Government Of India has largely incorporated the recommendations of the Award of the Cauvery Water Disputes Tribunal in the matters of implementing authority except the name and the ultimate power to act in accordance with the Award and Section 6A of the Inter State Water Disputes Tribunal Act.
The pertinent point of objection in respect of the draft scheme is that of ultimate power of ordering release of water to Tamilnadu. The relevant clause in the draft scheme is 3(XIV) wherein it is stated that if any of the states do not co-operate in implementing the decisions of the Authority, the central Government’s decision will be final and binding. This clause gives ample power to the central government to take political decisions and instead of that, the authority should be empowered to implement the decision. Otherwise, the authority will be toothless. Secondly, the Chairman and other permanent members deserve definiteness in the appointment and thus, any removal of the Chairman and other permanent members should be by the central Government and the concerned states.
The above points may be considered at the time of any discussions relating to the subject matter referred above.
